Acceptance of Terms

Ekaav is operated by Prowd Creative Technologies, a sole proprietorship based in India.
By accessing or using Ekaav.com ("Ekaav", "Platform", "we", "our", or "us"), you agree to these Terms of Service. If you do not agree, you may not use the Platform.

Eligibility

• You must be a business entity or an authorized representative to use Ekaav.
• You confirm that you have the authority to agree to these Terms on behalf of your organization.

Subscription, Payments, and Refunds

• Subscriptions are offered on a monthly or yearly basis.
• Payments are processed via Paddle and are subject to their terms.
• No free trials are currently provided.
• Refunds are issued only in cases of billing errors, duplicate charges, or other exceptional circumstances, at our discretion. See our Refund Policy for details.

User-Generated Content (UGC)

• Users retain full ownership of content uploaded to Ekaav.
• Ekaav does not claim intellectual property rights over UGC.
• By uploading content, you grant Ekaav a non-exclusive license to display it on the Platform.
• We reserve the right to remove content that violates laws, ethical standards, or our community guidelines.

Platform Availability & Updates

• Ekaav may update, modify, or discontinue features at any time.
• Service availability is not guaranteed, and we may temporarily suspend or restrict access as necessary.
• Users acknowledge that we are not liable for service disruptions, downtime, or feature removals.

Intellectual Property

• All platform design elements, branding, and trademarks belong to Ekaav.
• Users may not reproduce, modify, or redistribute platform content without explicit permission.

Data Protection & Security

• We follow industry-standard practices to protect user data.
• No system is completely secure; users assume the risk of storing data on the Platform.
• Refer to our Privacy Policy for details on data handling and storage.

Content Moderation & Compliance

• Ekaav reserves the right to review and moderate content for compliance with laws and guidelines.
• Inappropriate, unlawful, or misleading content may be removed without notice.
• Repeated violations may result in account suspension or termination.

Account Termination & Suspension

• We may suspend or terminate accounts that:
  • Violate these Terms or applicable laws.
  • Engage in fraudulent, abusive, or harmful behavior.
  • Fail to pay required subscription fees.
• Users may request account closure at any time, but refunds will not be provided for remaining subscription periods.

Limitation of Liability

• Ekaav is provided "as-is" without warranties of any kind.
• We are not liable for any damages arising from use or inability to use the Platform.
• Users acknowledge that they use the Platform at their own risk.

Dispute Resolution

• These Terms are governed by the laws of India.
• Disputes should first be attempted to resolve through good-faith discussions.
• If unresolved, disputes will be settled by arbitration under the Arbitration and Conciliation Act, 1996.
• Arbitration will be conducted in English and held in India.

Changes to These Terms

We may update these Terms at any time. Continued use of Ekaav after changes constitutes acceptance of the updated Terms.
